Rental spas — vacation rentals, Airbnb properties, and short-term rentals — are commercial spas under Florida law, regardless of how the property is marketed. The distinction matters because commercial-spa regulations are substantially stricter than residential, and hosts who don't understand the difference create liability exposure they often don't discover until an incident happens.
Florida's classification of rental spas
Under Florida Department of Health rules (Chapter 64E-9, F.A.C.), a swimming pool or spa used by transient or overnight guests at a rental accommodation is considered a public swimming pool/spa, not residential. This applies to:
- Short-term rentals (Airbnb, VRBO, rented vacation homes)
- Hotel and motel pools/spas
- HOA/community common-area pools and spas
- Multi-unit rental property pools and spas
The practical effect: the spa is subject to commercial-pool chemistry ranges, turnover rates, certified-operator supervision, record-keeping, and Florida Department of Health inspection.
Key code requirements (common provisions)
- Free chlorine3–10 ppm or bromine 4–10 ppm during operation.
- Combined chlorine under 0.5 ppm.
- pH 7.2–7.8.
- Cyanuric acid: not typically permitted on indoor public spas; limited outdoor.
- Turnover rate: 30 minutes maximum.
- Water temperature: 104°F maximum.
- Signage: hyperthermia warnings, maximum bather load, emergency shutdown location, maximum temperature.
- Emergency shutoff(“panic button”) within sight and reach of bathers; ground-fault protection.
- Depth marker visible from deck.
- Anti-entrapment drain cover VGB-compliant.
- Daily logs of chemistry, bather counts, and incidents.
Certified Pool Operator (CPO) requirement
Florida generally requires a Certified Pool/Spa Operator (CPO) to manage commercial pool and spa operations. This doesn't mean a CPO has to be on-site continuously, but:
- The CPO must be demonstrably in charge of operations and available when questions arise.
- Non-CPO staff can perform routine work under CPO supervision.
- The CPO is personally responsible for compliance and record accuracy.
Many short-term rental hosts contract with a licensed pool service company where the company's CPO serves as the operator of record.
Insurance implications
- Standard homeowner's insurance often excludes commercial use of a pool or spa. Rental pools need commercial-liability coverage, not just HO-3.
- Failure to comply with Department of Health regulations can void insurance coverage on a claim, even when the incident seems unrelated.
- Many insurance carriers now require proof of commercial pool/spa maintenance before issuing short-term-rental coverage.
What rental hosts actually need to do
- Engage a licensed pool service company with a CPO on staff, ideally one experienced with short-term rentals.
- Post required signage visible from the pool/spa area.
- Install an emergency shutoff if not already present.
- Keep daily logs— chemistry test results, bather observations, any incidents. Many service companies provide logbooks or digital records as part of their service.
- Verify the main drain coveris VGB-compliant and under 5–7-year replacement cycle.
- Document the maintenance program— adjusters and inspectors both ask for this.
Liability reality
Short-term rental pool/spa injuries are among the highest-severity liability claims in the rental industry. A drowning or entrapment incident can be a career-ending financial event for a host. The Department of Health rules exist to prevent these; compliance is insurance against both regulatory penalties and civil liability.
If you rent out a pool or spa, you're running a commercial aquatic facility — whether you think of yourself that way or not. Treat the chemistry, the equipment, and the documentation with that seriousness and your exposure drops dramatically.
